Our client was walking along Halstead Boulevard in Elizabeth City, NC on August 16, 2021 when he arrived at the intersection with Ehringhaus Street. Our client began crossing the street and was struck by the driver’s vehicle when he was roughly 20 feet into the roadway. Witness statements suggest that the driver never saw our client and never braked prior to impact. Our client was not in a crosswalk though one was nearby.
Our client suffered catastrophic injuries including a traumatic brain injury, liver/spleen/kidney lacerations, multiple rib fractures, multiple broken bones and septic shock. Our client was about to begin a new job, and the injuries and lengthy hospitalization cost him this employment opportunity. Now 8 months after the accident, he is still suffering from long-term pain and injuries.
The initial accident report blamed our client for his injuries, and the driver’s insurance carrier initially denied his claim based on “contributory negligence (a common defense that is described in more detail here). The insurance carrier argued that our client was at-fault for not crossing in a crosswalk.
Our team argued that the driver had the last clear chance to avoid the accident, which defeats a contributory negligence defense. Using science, we argued that Dr. Powell would’ve been visible to the driver for 250 ft (or more), and it would only have taken 180 ft for the driver to perceive, react, and completely brake to avoid the collision. Because the other driver didn’t even apply her brakes, we argued that she clearly as not paying attention or keeping a proper lookout and could have avoided the accident.
Rather than litigate the case, the insurance carrier paid the full policy limits to our client to settle.
