Our client was walking along Wake Forest Rd in Raleigh, NC on September 22, 2016 when she arrived at the intersection with Colby Dr. The driver was stopped at a stop sign on Colby Dr. when our client began to cross the street in an unmarked crosswalk. As our client was walking in front of the driver’s vehicle, the driver accelerated, knocking our client to the ground and dragging her several feet.
Our client, who had a prior history of back surgeries, suffered multiple injuries and required an invasive three-level spinal fusion surgery to address her pain and symptoms. She postponed the surgery and attempted conservative treatment for more than two years because of her fears associated with undergoing such an invasive procedure. The surgery required a lengthy rehabilitation and left her with significant abdominal scarring.
As part of the litigation, the driver admitted that he never saw our client or even looked in her direction before accelerating.
